2017 Representative Cases and Matters

Now that 2017 has ended, I thought I'd write up some examples of cases where I assisted client son property disputes and other matters in 2017.  This is a general list, and I don't state client names to protect their confidentiality.  If you have a similar matter and need assistance, please contact me. 

As 2017 ends and 2018 starts, I thought I’d look back and review some of the cases and matters I was involved in which ended in 2017.  To protect my clients’ confidentiality, names are not included.  If you need assistance in a similar area, please contact me.

Lake Michigan, Leelanau County.  Lawsuit against architect and engineer who failed to design a house suitable to build in an MDEQ High Erosion Area.  We resolved this dispute at mediation.

Petoskey, Emmet County, and Traverse City, Grand Traverse County.  Assisted local construction company with purchase of another construction company and its real property.  Follow up advice on problems with subcontractors.

Traverse City, Grand Traverse County.  Guided local homeowner through the termination of his residential builder and cleaning up construction liens filed against the property.

Traverse City, Grand Traverse County.  Assisted condominium owner who did not receive the windows outlined in her building plans.  We entered into an agreement with the developer which installed an acceptable window design.

Leelanau County.  Represented a small homeowner’s association in an action to determine whether an adjoining parcel was part of the development and, if so, whether it had to pay dues for the private road maintenance agreement.

Lake Leelanau, Leelanau County.  Represented landowner in dispute over a cell tower placed on his property.  Issues included zoning, encroachment, and access.

Charlevoix, Charlevoix County.  Assisted a highway construction company fighting allegations of improper work.

Benzie County.  Drafted ingress and egress easements for owner of several adjoining parcels.  Identified and corrected error the legal description in title insurance.

Harbor Springs, Emmet County.  Assisted landowner in evaluating options to access landlocked parcel.

Traverse City, Grand Traverse County.  Assisted developer which purchased commercial building in litigating terms of purchase agreement against seller.

Petoskey, Emmet County.  Defended residential builder in American Arbitration Association case filed alleging breach of contract in remodeling job.

Kalkaska, Kalkaska County.  Assisted local hospital in action to vacate a street and amend the village plat to allow construction of hospital buildings.
